OU student robbed at gunpoint Monday
by   |  February 25, 2005  |

University College freshman Joshua Teer said he never expected to be the victim of a crime when he enrolled at OU.

However, early Monday morning, Teer's expectations changed when he was robbed at gunpoint in the residence hall parking lot on Jenkins Avenue and Lindsey Street.

Teer said that around 3 a.m., he was coming back from a friend's house and wanted to call his girlfriend but didn't want to disrupt his roommate who was asleep in the dorms.

"I didn't want to disturb him so I just went to my truck and called her," he said. "I wasn't really paying attention to what was going on around me, because it was late at night, so I figured I didn't have anything to worry about."

Minutes later, a car pulled up behind his truck, Teer said.

"A guy with a mask knocked on my window, and I was shocked at first, but I didn't think anything of it, so I just opened up my door to see what he wanted," he said.

Teer said the suspect started cursing at him and demanded that he give him his wallet.

"Initially, I thought he was joking around, and I didn't see a weapon," Teer said.

According to a police reports, the masked man had a 12-gauge pump action shotgun and wore a white cloth over his head and face.

Teer said that when he realized the suspect had a shotgun, his whole mind frame changed.

"I was still talking on the phone with my girlfriend while the guy was trying to get my attention. The robber and me even started arguing for a little bit," he said. "It didn't get serious for me until I saw the gun. That's when I knew I better do what he said."

However, he said that at the time of the robbery, he never thought he was going to die or even that anything serious was going to happen to him.

"I was in total disbelief," he said. "It was so random, and it could have been anybody that got robbed. I saw a gun in his hands, and that was the only image I saw in my head."

After Teer handed over his wallet, the suspect got in the passenger seat of a 2001 Chevy Impala, according to a court affidavit.

Teer said that as soon as he had overcome his initial shock, he contacted OU Department of Public Safety.

While OUDPS recorded Teer's statement, the two suspects-the robber and the driver of the getaway car- were already using Teer's debit card, according to a court affidavit. Approximately five minutes after the robbery, the suspects attempted to withdraw money from an ATM.

After the ATM denied their transaction, the suspects tried to use Teer's debit card four more times throughout the morning, according to a court affidavit. Two of the attempts were successful, totaling $1,122.45 in purchases at a Wal-Mart in Norman and another one in Moore.

During the investigation, police detectives from Moore obtained the surveillance tapes from both stores and were able to identify one of the suspects, according to an affidavit.

Moore police positively identified Michael Vincent Rustad, 18, from the surveillance tapes, and OU Department of Public Safety arrested him Tuesday, according to an affidavit.

Wednesday, Oklahoma City Police arrested David Paul Wines, 20, after a warrant was issued for his arrest in connection with the robbery, according to an affidavit.

Wines and Rustad are charged with robbery with a dangerous weapon and a preliminary hearing is set for March 22 at 1 p.m., according to an affidavit.

Cleveland County District Attorney Tim Kuykendall said if both men are convicted, each could receive the maximum sentence of life in prison.
